NEW GLASGOW – A New Glasgow man will be back in court next month to enter pleas on two theft charges.
Michael Leroy Fanning, 46, was charged Jan. 20 in New Glasgow with stealing items valued at less than $5,000 from a Nova Scotia Liquor Corporation outlet. That charge is proceeding summarily, which typically carries a lesser punishment if convicted.
A second theft under $5,000 charge, however, is proceeding indictably, Crown attorney Herman Felderhof informed New Glasgow provincial court Monday morning.
That theft, which occurred Feb. 6 in Wal-Mart, may mean a tougher penalty if convicted.
“For one to proceed by indictment, it says to the court that they are substantially different in circumstances or amount,” Judge Theodore Tax explained to Fanning.
Fanning requested an adjournment to give him time to meet with a lawyer and recover from a surgical procedure. He’ll be back in court on April 26 to enter pleas.
