Conviction overturned: accused pleads not guilty, challenges ticket

NEW GLASGOW – A New Glasgow man is challenging a fine handed out by Westville Police claiming that he entered a property where he was not allowed.

Herbert Michael Koerner, 35, said he wanted to fight the ticket, which was laid under the Protection of Property Act.

Koerner told New Glasgow provincial court Monday that he was trying to pick his daughter up from daycare when he was given the ticket.

He was originally convicted earlier this month when he did not appear in court due to an error in the summons he was given. That conviction was overturned Monday and Koerner pleaded not guilty to the charge.

He’ll go to trial on July 26 on the matter.
