RMS fined $95,000 for death of two people in Mount Thom

PICTOU - Rotor Mechanical Service Limited was fined $95,000 in connection with the death of two people in 2009.

Provincial court judge Del Atwood said it was the highest fine given to date under the Occupational Health and Safety Act.

Rotar Mechanical pleaded guilty to three charges under the act earlier this month in connection with the deaths of Kyle Elliott and Mandi Balagot in July 2009.

The two were found in a shed and had died of carbon monoxide poisoning as a result of a faulty ventilated generator inside the shed.

During a court appearance in early August, RMS pleaded guilty to failing to ensure a Honda generator was installed and operated by the manufacturer's recommendations; failing to make all reasonable efforts were taken to ensure the health and safety of its employee, Kyle Scott Elliott; and failing as an employer to take reasonable precautions were taken to ensure the health and safety of Mandi Dawn Balagot.
