PICTOU – A 20-year-old Pictou Landing man has been found guilty of sexual assault.
Maurice Julian Denny was found guilty of the charge Wednesday in Pictou provincial court following a two-day trial held over the course of a few weeks. He was found not guilty of a second charge of unlawful confinement. Both charges were in connection to an incident in Pictou Landing on Dec. 17, 2012.
The victim testified that Denny had arrived at her home in the early morning hours of Dec. 17, wanting to "hook up" but she repeatedly told him to leave her alone.
She said his speech was slurred and he admitted to having a few beers with friends before coming to the home she shared with her father. The victim testified that Denny and she had never been boyfriend and girlfriend, but they had had sex in the past.
She said she wasn't interested in continuing this type of relationship with Denny because she was tired of lying to his girlfriend, who was also a friend of hers.
The victim said she thought Denny had finally left her home after she told him to leave so she went out to a shed that joins onto her house for a cigarette. However, she said, he followed her into the shed and locked the door behind him.
She testified she sat in a chair while he kneeled in front of her and he started kissing her. She said he touched her vagina with his fingers and gave her hickeys on her neck. She said she told him to stop, but he lowered her to ground and got on top of her. The victim said she bit him on the shoulder to get him off her, after which she left the shed and returned to her home.
The victim said she told a support worker at the school who encouraged her to contact police.
Denny testified Wednesday saying that he contacted the victim over Facebook and she agreed to meet him later outside her house. When he went over to her home, he suggested they go to the shed because it was raining and they were both getting wet. He denied locking the door of the shed.
He said they were kissing, but she stopped him, telling him she couldn't do it anymore with him because of his girlfriend. He said he stopped kissing her, got up and they shared a cigarette.
However, under cross-examination, he admitted to touching her vagina over her clothing during the incident and he told the court that when they entered the shed he asked her what she wanted to do and she said "I don't know," so he started kissing her.
Denny testified that he admitted to police that he touched the girl's vagina with his fingers, but only did so because he was feeling pressured by police to say something or he wouldn't get home anytime soon.
Judge Del Atwood rendered his guilty verdict immediately following summations by both the Crown and defence, saying the victim's testimony was credible while the accused's testimony came across as "self serving."
"He (Denny) was a guided missile who showed up at the victim's house for a sexual encounter she did not want," he said.
As for the unlawful confinement charge, Atwood said he believes the accused did get on top of the victim, but it was for a sexual purpose rather than confinement.
He also added the court wasn't satisfied that Denny locked the door to the shed on purpose considering it was a push lock on the handle. He said if it had a dead bolt or chain lock, it would be easier to determine if such an act took place.
Denny will be sentenced Dec. 9 in Pictou provincial court.
