Accused asks to call more witnesses in arson case

PICTOU – A provincial court judge was set to deliver his verdict Monday in the trial of Westville man accused of arson when the defendant asked to call two more witnesses to testify.

A request by 45-year-old Daniel Kenneth Stewart to have two more witnesses testify was granted by Pictou provincial court judge Del Atwood despite the fact that closing arguments were heard and the judge was set to deliver his verdict.

The court will hear from the two witnesses on Feb. 11. Stewart has pleaded not guilty to break-and-enter and arson in relation to a fire at an abandoned home in that community. His trial began Sept. 25 and was held for three additional days in December.

Stewart has pleaded guilty to an unrelated charge of damage to property and will be sentenced on this offence at a later date.
