Man convicted of fraud to be sentenced April 30

PICTOU – A Pictou County man convicted of multiple fraud charges involving credit cards will have to wait another day for his sentencing.

Tyler Russell Butts, 28, was anticipating being sentenced Monday in Pictou Provincial Court, but Judge Del Atwood said he didn’t feel comfortable going through with the sentencing as a court judge because he acted as the Crown attorney when Butts appeared on previous charges in 2009.

The sentencing will take place on April 30 in front of another judge who does not have a conflict with the case. He was charged with seven counts of credit card fraud in 2009 in addition to recently pleading guilty to more charges of theft and possession of stolen property in 2013.
