Man acquitted of drug charges due to rights violation

PICTOU – A 30-year-old Westville man facing drug and weapon charges had his case dismissed Tuesday in Pictou provincial Court.

Both the federal and provincial Crowns withdrew their charge against Jeffery Dale Jenkins about two hours after a trial started on charges of production of marijuana, possession of marijuana, possession of cocaine, possession of ecstasy and two charges of unsafe storage of a firearm.

The charges stem from an arrest in September 2013 at a Westville home.

However, defence lawyer Ed Patterson filed an application that his client’s charter rights were violated during the course of the investigation that led to the charges. After hearing testimony from the first RCMP officer at the scene, the Crown dismissed its charges and Jenkins walked out of court a free man.
