Man goes to jail for assaulting elderly woman

PICTOU – A 45-year-old Alberta man has been sentenced to six months in jail for assaulting an elderly woman and a police officer.

Ruben James Andrews, who has been living in Stellarton for few years in the same home as an 89-year-old woman, pleaded guilty Monday to the charge of assault causing bodily harm, assaulting a police officer, and two charges of possessing illegal drugs.

The court was told that Stellarton police responded to a disturbance call in Stellarton on June 10 and when they entered the home, they found Andrews cursing, unsteady on his feet and intoxicated.

Police were told that he started swearing earlier in the day and when he wouldn’t stop, the elderly woman said she was going to call the police for help. He grabbed her arm and ripped the phone cord from the wall, telling her she wasn’t going to call anyone.

The Crown said he pulled three dime bags of cannabis marijuana out of his pocket and a pill bottle. A total of 19 grams of marijuana was seized in addition to 38 morphine pills.

Andrews remained confrontational when police read him his rights to place him under arrest and he threw his shoes at an officer when he was in cells at the local police station.  The Crown said he also continued to be verbally abusive to the officers.

The Crown said Andrews has a criminal record that dates back to 1998, but his last recorded conviction was in 2007.  

Andrews apologized to the court, saying he didn’t mean to cause any trouble while he was in Nova Scotia.

“I had no intention to harm anyone in this province,” he said. “I just want to go back home. 

Judge Del Atwood called the assault a “form of elder abuse” and sentenced Andrews to three months for each of the assault charges and three days for each of the drug possession charges. One drug sentence will run concurrent to the other.

Andrew’s lawyer requested the court make a recommendation that he serve his sentence in Alberta so that he could get better treatment for a medical condition, but Atwood said it was unlikely that would happen.

    this is sad 3 months for assulting an 89 yr old woman and 3 days for drug charges .. this guy must have known someone important in the community ---our justice dept should be ashamed.I am 65 and was assulted but I didn't report it because I knew nothing would come of it--SAD

      6 months for grabbing someones arm and verbally threatening them is pretty significant.
