Robert Douglas MacInnis, 24, and Corey Michael Calvery, 23, are both charged with break-and-enter into a dwelling house with intent to commit assault, in addition to several other charges.
The charges were laid in connection with an alleged home invasion on Grandview Avenue, Trenton, on March 4, 2013. Police say four males went to the household and two men forced their way into the residence and threatened the two lone occupants inside.
Both men had originally elected to have their cases heard in Supreme Court by a judge alone, but their lawyer re-elected a trial in provincial court. MacInnis’s trial will take place July 15 and July 17, while Calvery’s case will be heard July 24 and July 31.
Crown Attorney Bill Gorman informed Judge Del Atwood that he might be filing an application for the judge to recuse himself since he also already listened to the trial of one of the co-accused, Micah Osborne.
However, Gorman said, if the defence and Crown can agree to a statement of the facts, the recusal may not be necessary so all parties involved agreed to wait to see if such an application is needed.
Osborne was found guilty in Pictou provincial court of mischief, but not guilty of the break-and-enter charge. He will be sentenced on May 13.
A fourth man, Franklin Crook, as elected trial in Supreme Court at a later date.
