Lawyer appears for student charged in fatal Dartmouth car-pedestrian crash

High-profile lawyer Joel Pink appeared in Dartmouth provincial court Wednesday on behalf of a Bedford student charged in a fatal car-pedestrian collision in February.

Matthew Gerald Kennedy, 24, has been free on bail since Feb. 25 on charges of criminal negligence causing death and failing to stop at the scene of a fatal accident.

Pink told the court he has yet to receive evidence disclosure from the Crown. He said he expects to get the evidence within the next two weeks and will need time to review the material and discuss it with his client.

Judge Alanna Murphy scheduled the case to return to court in late May.

Gary Rogers, 57, died Feb. 22 after he was struck by a vehicle while crossing Pleasant Street in Dartmouth at about 5:50 a.m.

Kennedy was arrested that afternoon after someone spotted a parked vehicle that appeared to have been involved in the incident.

Kennedy, a radio and television student at the Nova Scotia Community College’s Ivany campus in Dartmouth, was released from custody on a $1,500 recognizance.

He must remain in Nova Scotia, live at a residence on Stoneridge Court in Bedford and observe an 11 p.m.-6 a.m. curfew. He is prohibited from being in the driver’s seat of any vehicle and cannot apply for a passport.

Prosecutor Scott Morrison announced Wednesday the Crown is proceeding by indictment on the charges.
